Big Tech Unites Planet … Against Them, Over Political Censorship

I never thought I would see a day when German President Angela Merkel would defend Donald Trump (archive). But, she gets it. Social media is now a key way people discuss politics. So, when a person is banned for their opinions, it is like the phone company saying you cannot talk on their phones, because they do not like what you say. That is not to say some measure of control is important – terrorism is illegal on an old fashioned phone and it should be illegal on social media. However, it is not for Mark Zuckerberg and Jack Dorsey to be deciding what is acceptable speech.

Imagine you are a politician. You observe, in the middle of a US Election, a group of powerful companies undermine a candidate’s campaign then ban them on contentious grounds. That candidate is the incumbent President of the United States of America. Regardless of party or nation, a chill would hit your stomach. Because, if it can happen to the most powerful politician on Earth, it can happen to you. Boris Johnson here in the UK gets it. He got it in November, according to the Daily Mail (archive). Merkel gets it. the French get it. It is now a priority in nearly every Western Nation. Trump’s ban hit them where they live.

The ban of Parler too was crass. It was as if Dorsey, Jeff Bezos, Zuckerberg put on tutus and, “We am r hav oligarchy an’ monopoly iz sexi” t-shirts before doing a high-kicking song and dance routine about their excessive market power on the front page of YouTube. In the short term it revealed their power. In the long term it all but guaranteed that power will be taken away.

The problem is that Zuckerberg and Dorsey are not politicians. They had a metallic fist that they had hidden in a velvet glove behind impenetrable walls of complexity such as post ranking algorithms. Their soft power, had they kept it soft, would have been hard to challenge and could have stayed obfuscated – at least enough to deter politicians and keep it a lower priority issue. Instead, they made the fatal, politically maladroit decision to take off that glove and reveal the stainless steel cyborg fist by starting banning mainstream commentators and politicians. They had the power but not the wisdom as to use it discreetly.

Big Tech are alleged to have sought to influence elections not just in the United States but in other countries such as Uganda, which has banned them until at least after the election. North Dakota already has legislative proposals (archive).

Every politician in the world now agrees there needs to be regulation to protect speech. In the UK and US this favours the right. Because, as soon as the government becomes the arbiter of who and what the social media companies can ban the 1st Amendment applies. In the UK, whilst our free speech laws are weaker they are still more permissive than Twitter. In a December judgement, British judges held that mis-gendering was protected speech (archive). In the UK, when a private institution is carrying out a public function, it is subject to the Human Rights Act 1998 (which includes the UK equivalent of the 1st Amendment).

Another group likely to benefit is #GamerGate. For years, they complained of social media censorship. Now, nearly every government in the world has rushed it to near the top of their agenda. The politicians have been hit where they live. Suddenly, the arguments of the likes of Zoe Quinn and Anita Sarkeesian seem immeasurably less convincing. Even in defeat, Trump may end up winning one of the most important fights in the free world today.

Twitter Threatens to Sue! Del Harvey and Vijaya Gadde Double Down

Facebook’s Mark Zuckerberg once famously described Twitter as being like a clown car that crashed in a gold-mine. Their latest antics, involving their lawyers at Bristows, include writing me one of the worst ‘libel’ letters I have ever seen. The specific lawyers on the case are Alex Keenlyside and Robert Graham. I reproduce the relevant parts below. Then I school them on procedure and more importantly the substantive facts of their case.

I received a letter just past 8pm on Friday night. It is a trashy tactic solicitors use that works with many people. However, although I do not practice as a solicitor I have passed the exams (LL.M LPC Commendation) and have nearly 9 years experience as a McKenzie Friend. I have written the pleadings of multiple libel cases so late night letters are less impressive to me, especially given the obvious, negligent and improper failure in this one to comply with the relevant UK law, the Civil Procedure Rules.

Much of the letter is a request for information. Twitter asks for court documents relating to the recent court case in which Esther Baker was found liable for racist harassment because of various proposed legal claims against it, in multiple jurisdictions. The last paragraph however is a demand I remove an article, which is said to be defamatory. Twitter are concerned with my article of 14 April 2020, headlined, “Twitter’s Del Harvey / Alison Shea and Vijay Gadde Openly Back Child Rape Stalker and Anti-Semite Racist”. So far they have not sought to challenge my article, “Labour’s Secret Deal with Twitter and Facebook to Surveil its own members”.

The article complained of referred to Twitter’s decision not to remove proven racist stalker Esther Baker’s account nor the tweets held by a judge to be racist stalking. The same article complained of Twitter’s failure to remove anti-Semitic material posted by a man named Alan Goodwin. As previously covered on MHN, Esther Baker has been successfully sued by former MP John Hemming and a child abuse victim who MHN is anonymising as a courtesy. Twitter, of course, has rules against racism and ‘targeted harassment’ so one would think in light of the lengthy judgement to the effect that Baker engaged in racist targeted harassment over a period of years the issue would be a no-brainer. Nope. “Clown Car”!

Supreme Court: the US Federal Government Can in Fact Regulate Private Company Editorial

Earl Warren, left leaning Supreme Court Justice, ruled in favour of regulating private corporate speech to be fair to all sides.

The recent decision by the Trump administration to collect evidence of political bias at social media companies is to be welcomed. However it has led to gloating on the Left, and concerns on the Right about the legal issues. The First Amendment to the United States Constitution, it is said, prohibits interference by the Federal Government or by Congress. Rubbish! The Supreme Court has already upheld such legislation, and not even the recent, Conservative leaning Supreme Court but the Left-leaning activist Warren Court. I am speaking of course, of the FCC Fairness Doctrine (archive).

The Fairness Doctrine was a rule imposed on early, analog, radio broadcasters as well as television broadcasters. Because there were few radio television channels, they operated as gatekeepers to the national political conversation. As a result, over a number of cases the Federal Communications Commission (FCC) began treating them somewhat like utilities.

The Mayflower Doctrine was a ruling of the FCC in 1941 that radio stations were prohibited from editorialising in matters of news or politics for fear that they would otherwise simply be used to propagandise on behalf of Conservative business owners. It was superceded by the later, ‘Fairness Doctrine’. The rule required that broadcasters dealing with controversial issues present both sides, grant equal time to both sides and give those publicly criticised the opportunity to respond.

Eventually, a company called Red Lion Broadcasting challenged the rule and the litigation made its way to the Supreme Court. Which ruled unanimously in favour of the FCC. The full case name is, Red Lion Broadcasting Company, Incorporated, et al. v. Federal Communications Commission, et al. and the court’s opinion can be found here.

HELD (amongst other things) – The fairness doctrine and its specific manifestations in the personal attack and political editorial rules do not violate the First Amendment.

Patreon Banned Sargon Yet CEO Jack Conte Allowed Distribution of Illegal Child Pornography and Laundering of the Proceeds

Carl Benjamin (Sargon of Akkad) was banned from Patreon this month for comments not made on the platform. This appears to contradict Patreon’s own statements and some of its actions may arguably violate several laws including the European General Data Protection Regulation (GDPR). That is not just an academic problem, because according to its public website Patreon has a business entity in the UK (archive) – Patreon DLC, Ltd. 8 Soho Square, London, Greater London, W1D 3QL. Sargon could (and arguably should) take action on it. Before I turn to that issue though I would like to remark upon the matter of Patreon ands its CEO Jack Conte knowingly allowing the distribution of illegal child pornography on the platform – at least until I asked VISA and MasterCard to investigate.

I first took a journalistic interest in Patreon last year in my first article and it is worth a brief recap. Lauren Southern, beautiful and extremely capable Canadian journalist had been banned for allegedly endangering the lives of refugees. Incidentally Lauren has now been vindicated – a ‘sting’ recording made on her behalf of an NGO official has proven her correct (archive). Many of the alleged ‘refugees’ were in fact fraudulent migrants facilitated by unscrupulous ‘charity’ workers who groomed them to lie. The only people endangering lives were those helping them make dangerous sea crossings to, at best, an uncertain welcome.

However, my interest arose from the illegal content available on the Patreon platform. A whistleblower sent me a link to the page of a creator called, ‘Waysin’. The page showed a number of censored and blacked out cartoon style drawings of young, underage boys and tentacles. The images were legal, but it was made clear that for a fee the user could view the images without censorship – that is pictures of clearly underage pre-teen boys being bestially raped by tentacles. Such images are criminal to produce, distribute or possess in many states, including Taiwan where the creator of the material said that he lives. For bonus points, Waysin said openly on the public page that he knew the images were illegal in his jurisdiction. Needless to say, I reported the page to Patreon. I did not view the private section – for the avoidance of doubt no unlawful images were viewed or downloaded preparing this article.

Patreon knowingly allowed a user to distribute sexual material related to children that was illegal in the jurisdiction of the user. They allowed them to literally launder the money via Patreon. This account was drawn to the attention of Patreon and Jack Conte personally, but not removed – at least until I involved executives of the payment networks. Click for full size.

Twitter Disables Donald Trump’s Account – Mr President, Please, Get On Gab

In the latest epic Twitter fail, the ailing social network disabled the US President’s account for 11 minutes. It was restored later and the network claimed the outage was due to an employee on their last day. The lack of professionalism speaks for itself.

Twitter – Like Someone Crashed a Clown Car Into a Gold Mine!

The negative experiences of Trump and other Right-wingers on Twitter mirror my own. In 2016 I was temporarily suspended from Twitter. After legal correspondence, they unsuspended me but after various further Twitter fails I deleted my accounts. Subsequently, trolls impersonated me using my old names and I had to make further legal threats to get them banned.

Twitter also did not even act in a timely fashion to ban an account claiming to represent the ‘Child Porn Captial[sic] of the Internet’ until I and others put in media inquiries (including my threat to have Jack Dorsey personally served with legal documents and to invite Breitbart to photograph said delivery).

Twitter is not the only option – there are new games in town including social media network Gab, which has repeatedly and unfairly been accused of being a platform for white supremacists but which in fact hosts a growing and diverse community. Gab still has a way to go of course, like any social media network. I would like to see Andrew Torba and Vox Day reconcile.

If Trump were to move to Gab, praising the social network for its diverse voices, he would cause a massive influx of users to Gab and a crash in Twitter stock prices.

Jubilation as Loathesome Twitter CEO Jack Dorsey Excluded from Key Meeting with Trump

In a display of his noble leadership and clear vision Donald Trump has excluded controversial Twitter Chief Executive Jack Dorsey from a key meeting with leaders of the technology industry. Politico alleges that this was due to Twitter refusing to participate in an ad campaign involving a ‘crooked Hillary’ emoji (archive here). I say, “Who cares? There are many, many good reasons to exclude Jack Dorsey from meetings forever”.

Twitter is no American success story, instead as Mark Zuckerberg famously said, “They Drove A Clown Car That Fell Into A Gold Mine’”.

Twitter is a social media website that has lost “a staggering amount of money” according to Time magazine, which put its losses over $2 Billion (archive here). That was in February and Twitter has continued to lose way more money since then as set out in its series of disappointing quarterly financial reports. Despite hundreds of millions of users, Twitter stock continues to fall.

Rumours of buyers come and go, giving temporary boosts to the company before dissipating into the mists. The fundamental problem with Twitter is that years after it was first set up it still is not making its owners any money. At the same time, Twitter has been criticised for failing to deal with terrorism, paedophilia, bullying and also with political bias.

Twitter Will Not Rule Out Banning Donald Trump. Trump Should Ban them and Join Gab.ai

Twitter does not like us? Well we do not like them?

According to the Independent, Twitter will not rule out banning President-Elect Donald Trump (archive here). The Witchfinder responds along the lines of ‘F*** Twitter’ and points out that Donald Trump could humiliate Twitter and energise the Right by ditching Twitter for its smaller but rapidly growing rival Gab.ai which is friendlier to Republican voices.

Earlier this year I started work on Fitter – a Twitter rival (F*** Twitter). Gab beat me to it and frankly is pretty damn good. I may still do my offering but I do not want to compete so it will now be something more like a Reddit / Twitter hybrid. Gab is very impressive and I wholeheartedly support Andrew Torba.

Why is Trump still on Twitter? The site is a dying anti-Conservative platform with plummetting stock value and the hatred of right-wingers everywhere. Recently I identified members of a paedophile hate group called Kiwi Farms on Twitter. One member was openly calling for genocide including cutting off the fingers of Jews. Another exhorted users to visit the ‘Child Porn Captial [sic] of the Internet’.

Several users had reported the tweets with no effect. Only when I personally threatened Jack Dorsey with litigation and to invite Breitbart to photograph him being served with documents did Twitter suddenly take action. Similarly Twitter has never taken action against journalist Sarah Jeong who named a rape victim using the platform.

“Vordrak was right”. It is good to be appreciated. Some of you may have noticed last week the disappearance of a large number of Kiwi Farms accounts, but not known why. Now that 4Chan and /Pol/ have begun to move, it is time for me to reveal the horrific and unimaginably depraved truth.

According to Anonymous, Twitter has been hosting an international paedophile ring in which thousands of perpetrators shared child pornography openly in tweets. I have no idea whether it is in the 24,000 range as the Anonymous campaigners allege, but certainly I am aware of online abusers that Twitter has failed to deal with.

The opening moves came on Friday when I sent a friendly message to Twitter. Now everyone knows that under CEO Jack Dorsey’s failing leadership reporting tweets is a haphazard process at best. Perhaps that is why no one wants to buy the ailing social network and it recently announced the closure of Vine. The risible failure of Twitter to deal with complaints in a reasonable way is widely seen as contributing to the collapse of Twitter’s share price.

Several people including two journalists had reported ban evading users. One of those users had sent adult penis photos to a hashtag used by children and as a group they were suspected of sharing illegal child pornography. The users also openly threatened to mutilate jews.

After nothing was done, I put my LPC Commendation to good use and sent a friendly note to Twitter’s legal team. An extract from my message is as follows –
