Some angry judges. What might happen if this went to court.
Firstly, I agree with the barrister that the conduct is indirect discrimination and in any event as he says the current rule book confers no such power. However, I would add that if it did, it would likely fall foul of –
Where expulsions from political parties are litigated, there is also case law requiring clubs and other such organisations to follow their own rules, for example, Lee v Showmen’s Guild of Great Britain 2 QB 329. I also observe that it is particularly disturbing if Labour are using a bot on either Twitter or Facebook to expel people.
This article is based on a judgement reported and made public by HHJ Hilder. I have discovered the identities of some of the abusers but for now I have precisely followed the judge’s anonymisations whilst I clarify the precise court orders in force. In due course I may, if necessary, apply to the court for a variation.
SHAME – Worthless Labour councillor Doug Taylor is leader of Enfield Council. The abuse happened on his watch, yet he has not apologised to victims and their families.
In summary, the London Borough of Enfield, by some procurement process that remains opaque (and in relation to which Enfield seem to have ignored my questions), decided to outsource the management of the property and affairs of vulnerable clients. In the UK, if a person lacks mental capacity to manage their finances due to (for example) dementia or severe learning disability, then they may be subject to a Deputyship – a court order appointing someone to do it for them.
Matrix Deputies is a UK limited company and the judge has permitted them to be named. The company and its officers were involved in Deputyships for 52 clients, 8 of which are now dead. The court proceedings began when the UK Public Guardian applied to terminate all of those Deputyships on the grounds of financial abuse. According to the schedules in the judgement, incidents of concern were occurring at least since 2014.
After the Public Guardian made the application it appears at some point the London Borough of Enfield was appointed as an interim Deputy by order of 17 February 2016 was ordered to investigate the affairs of the clients and the dealings by Matrix. This investigation was conducted on the council’s behalf by PwC, the well known accountants. The investigation cost roughly a quarter of a million pounds (£250,000) in part due to non-cooperation by Matrix Deputies. The money has yet to be fully recovered.
The new actor portraying Dr Who, Jodie Whittaker, has waded into a highly charged and controversial debate about back pay for low-paid vulnerable care workers. A number of care organisations have been found to be unlawfully paying below minimum wage and the government has been seeking back pay. Ms Whittaker has sought to help the charities avoid their liabilities, backing a campaign for the taxpayer to foot the bill instead.
This disabled worker had to use a food bank when MenCap paid him less than £3 an hour. Click for full size.
I have stayed out of the heated debate about the casting of a female Dr Who. Recasting a much loved character – even changing the colour of their cape – is often a controversial topic. Fans grow attached to characters who (being fictional) are defined solely by their brand and fictional attributes. Turning the entire Time Lord people into a race of transsexuals by retconning the possibility of regeneration into another biological sex was always a controversial proposition.
For my part, please note that I do not condone criminal activity of any kind. If this site receives emails from persons contemplating or committing serious future or ongoing criminal acts such as terrorism or violence I shall disclose them to appropriate law enforcement agencies without warning.
Kiwi Farms NOT (KFN) is a sinister forum set up to harass Joshua Moon’s family in retaliation for his creation, Kiwi Farms. The URL has been blacked out and although the forum can easily be found on Google it will not be linked from here. Click for full size.
Websites www.CheckAdsenseBan.Com and IsBanned.com both report KiwiFarms.net and KiwiFarms.is are banned by Adsense. Click for full size.
In the latest humiliation for Kiwi Farms and its owner Joshua Conner Moon, its Google Adverts seem to have disappeared as of a week or two ago. Whilst Google never comments publicly on such matters, two separate online tools confirm that KiwiFarms.net and KiwiFarm.is are banned.
The ban is a major humiliation for Joshua Conner Moon. Ranksays.com estimates that the site is worth $439 per month and that money is now lost to Joshua Moon and his company LOLCow LLC. It is widely acknowledged that Google are one of the best advertising networks by far.
Gabe Newell the CEO of Valve Software, shamefully allows members of a site that exists solely to harass the disabled, women and children to remain on Steam even after they tried advertise their site, which PayPal recently banned due to its hosting of depraved abuse content. Steam is one of the world’s best known and best loved gaming platforms. It revolutionised the video games market, bringing instant downloads and regular updates to millions of consumers.
Valve Software’s store, however, has a dark side in which sinister and systematic harassment of women, the mentally disabled and even pre-teen children is glorified by a small minority of users.
Recently CEO Gabe Newell and his VP of PR Doug Lombardi were warned of a Steam Group for Kiwi Farms. Whilst the group disappeared soon afterwards Steam has failed to ban the malevolent paedophile minority who made up its members and organisers.
The internet has many sites. Some are good, some are bad and some are simply revolting dregs.
One such dreg is Kiwi Farms. Their mission is clearly set out in their surprisingly honest marketing material. It is worth revisiting the logo they had on their Twitter account before I (along with others) had it permanently suspended.
Strong Leader: PayPal CEO Daniel Schulman was personally notified of the sickening paedo-sexual abuse on CWCki and the company took swift, decisive action. Image courtesy of Wikimedia commons, CC-BY-SA-2.0 license (archive here). Author Kris Klug, Poptech.
CWCki, or ‘Christian Weston Chandler Wiki’ is a website set up by abusers to stalk a vulnerable, mentally disabled man of the same name. Many sites have been set up to stalk and harass Christian Weston Chandler (CWC) over a period of years, apparently for no better reason than he ran into the wrong people on the wrong day.
Content on the site includes lengthy and detailed transcripts and audio of phone sex between CWC and a 13-year-old boy known as BlueSpike who had been enticed into posing as a 19-year old woman for the sick amusement of the deviants who run the site.
For many years, CWCki used PayPal as a payment processor, holding an account associated with the email address, “email@example.com”. PayPal terms of service (archive here) prohibit accounts being used in connection with activities that may,
Condemning allegedly ‘sexist’ remarks by a respected lawyer. Labour ‘politician’ Jessica Asato remarked that, “I would rather be complimented on my achievements than my face” (archive here). The comment echoes Martin Luther King’s famous quotation, dreaming his children would, “[…] not be judged by the color of their skin but by the content of their character […]”.
The remark is typical of Asato’s narcissistic and self-absorbed conduct – but if Jessica wants to be judged by her achievements and character rather than her appearance your author is only too happy to help.
I was horrified to read Mark Neary’s recent article about the reality of ‘supported living’ in some local authority facilities.
Mark had identified a supported living facility in a local authority catchment area. The facility was originally a care home with 20 rooms.
It was converted to ’20 supported living studio flats’.
The reality he describes is of a building with 20 ‘flats’, 2 toilets, 2 bathrooms and fewer staff. Leaving aside the poor quality of the care provided, your Inquisitor is concerned with the Deprivation of Liberty issues. Why?
The Deprivation of Liberty Safeguards do not apply to supported living arrangements.
Depression quest – depressingly bad. Condescending to people with mental health problems but has escaped scrutiny due to its author’s PC credentials.
The Witchfinder reviews a truly appalling game called Depression Quest (DQ), written by Zoe Quinn from the #Gamergate controversy. DQ combines condescension with poor execution. Bizarrely, the supposedly ‘right on’ media has actually given this game a pass due to the author’s alleged PC credentials.
The Witchfinder says it is time game journalists stop defending Zoe Quinn and promoting her work – not for gender reasons but because of her comments on mental health issues.
For those of you new to this blog, the author is a law student. Your Inquisitor spends a lot of time helping vulnerable people and their families in Court, pro-bono, as a McKenzie Friend with a specialism in Mental Capacity (the Court of Protection). Since starting this blog some years ago, the Witchfinder has actually passed some exams and now holds a Graduate Diploma in Law. He has moved on to studying a Master’s Degree in Law combined with an LPC (British equivalent of a US attorney’s certificate).
This blog is mostly about politics, with law and the very occasional game review.
One of the first things you need to know about UK Equality Law, which is mostly codified in the Equality Act 2010, is that having the same characteristics does not get you off the hook (s24). So for example, a female boss who fires a worker for getting pregnant is not off the hook for being female. Similarly, having the same disability does not get you off the hook for discrimination. Actionable discrimination need also not be deliberate it could be by accident or even subconscious – see Swiggs and Others v. Nagarajan UKHL 36.
